Access to and use of this site and the products and services available through this site ("services") are subject to the following terms and conditions ("T & C"). By using the Services, you agree to all T&Cs, as we may update or modify the T&Cs from time to time. You should check this page regularly for any changes to the Terms and Conditions.

Placing orders on this site means accepting the T&C.

PAY BY CARD

Together with TBI Pay, we have implemented a financing system directly from the shopping cart, which allows you to pay in installments, without trips to the bank. You only need to have your identity card handy and have a source of income registered with ANAF (salaried employee with at least 3 months of experience, pensioner or PFA with at least 12 months of experience).

Your file will be analyzed, and you will receive confirmation of the approval or not of the credit by email. Your order will be shipped only after our team receives the credit approval confirmation email from TBI.

DELIVERY

The transport cost for Bucharest is 23 LEI, and for the other cities in Romania it is 29 LEI(card payments). Exception: localities without Fan Curier headquarters - outside kilometers will be charged with the client's consent.

MOOGU ships orders placed on the online shop with DHL Express to the following countries:

Delivery of orders takes between 2-7 working days for Europe and up to 18 working days for the rest of the countries, depending on the selected delivery address. The order will be delivered to the mentioned address, and only if the courier does not find it, you will receive a notification in the mailbox. In this case, it is your responsibility to pick up the package from the local postal office where you belong.

For online orders with delivery outside the European Union, extra customs fees may be charged, depending on the local policies and taxes of your region.

Most orders are shipped the next business day after the order has been placed. As soon as the order is confirmed and processed, an automatic email will be sent including the shipment number.

The processing time of orders paid online by card can be extended if the billing address is different from the delivery address. (this additional time is used to ensure the safety and security of the card you use)

* DELIVERY/MAKING OF THE RING - after placing the order on the website, if you want to order them online, you must specify the sizes you want (in an email sent later on contact@moogu.ro). It takes 14 working days to make the wedding rings and a 50% deposit is paid before the order starts.

DUTY

International orders outside the EU area may incur extra local customs fees when they enter the destination country.

RETURN OF PRODUCTS

The policy of returning products purchased from the www.moogustore.com store is in line with the provisions of Emergency Ordinance no. 34 / 2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts and GEO no. 140 / 2021 regarding the sale of products and their associated guarantees.

Purchased products can only be returned in their original packaging, without being used, worn or damaged or with missing elements, accompanied by the original bill of sale (invoice/receipt) and the original certificates of authenticity issued by MOOGU. Any promotional product or packaging offered as a gift together with the purchased products must also be returned under the same conditions described above, within 14 calendar days of receipt.

MOOGU will refund the value of the returned goods within a maximum of 3 working days from the date of return of the products, by bank transfer. The direct expenses caused by the return of the goods (transportation of the goods) will be fully borne by the buyer and the return of the products will be made using the same transport service with which the products were sent to you. The value of the returned products will be returned less the delivery fee.

All special orders are non-refundable, according to OGU 34/2014, art 16 letter c.

Special orders are products created and requested by the customer according to the customer's specifications, in this category including wedding rings, engagement rings, created to the sizes ordered by the customer, even those not engraved.

The right of withdrawal does not apply to products that have been personalized with engravings.

This category includes, but not exclusively: jewelry created according to the sizes ordered by the customer, even unengraved ones, decorations made with a design described and requested by the customer, any other items made to special order, whether or not based on starting (in terms of shape, color, design, dimensions, material, etc.) an item from the store, but for which the special adaptations requested by the customer have been made.

If the customer has paid the 50% advance for a special order (wedding rings, engagement rings, other jewelry) and changes his mind and wishes to return the money, this is not possible.

If the customer wants to bring gold as a deposit as a deposit, for special, personalized orders, engagement rings or wedding rings, it can only be returned under certain conditions.

The right to cancel the purchase does not apply to Gift Cards/Vouchers.

However, we assure you that we will do our best to solve amicably any problem that may arise during the course of the collaboration with you.

INFORMATION REGARDING THE RIGHT OF RETURN

When do you have the right to return an ordered product (withdrawal from the contract)?

If a product ordered by you that does not require execution (it is in our stock at the time of ordering) turns out not to comply with the specifications presented on the website or in the offer submitted following a prior dialogue, you can request the return of this product (withdrawal from the concluded contract remotely, according to art. 9 paragraph 1 of GEO no. 34 / 2014) without having to justify this decision, within a maximum of 14 calendar days from the date on which you take physical possession of the products (the date of receipt of the package, certified by the documents provided by the courier company).

Necessary formalities

To exercise your right of withdrawal, you must inform us about your decision to return the product (withdrawal from the contract), by writing to us at the address: contact@moogu.ro, in which you express your decision to return the product(s) ) ordered. We will send you an email confirming receipt of your request to return the ordered product(s) without delay.

How do you return the product(s)?

The parcel with the returned products will be sent by the customer to the address: Str. Brezoianu, no. 4, floor 1, ap 2, sector 5, Bucharest, telephone no +40 (755) 893 915.

Refund of paid amounts:

We will refund all the amounts we have received as payment from you, within 3 working days from the date of return of the products. The refund of the amounts will be made in compliance with the above terms, but not earlier than the receipt of the product(s) that was the subject of the sale and, respectively, of the withdrawal (return) request.

Non-reimbursable costs:

The direct expenses caused by the return of the goods (transportation of goods and money return commissions) will be fully borne by the buyer.

WARRANTY RETURN INFORMATION

We undertake to deliver products that are in accordance with your requirements and with the tax documents issued to you. If after receiving the ordered product(s) you notice a non-conformity, as defined in GEO no. 140 / 2021 regarding the sale of products and their associated guarantees, or you find that the products require size adjustments, you can return the ordered product(s) for remediation.

All products are guaranteed against defects in workmanship or manufacturing. If such a defect is found, the product will be repaired or replaced with another one, and if it is not in stock, the buyer has the right to either choose another product in stock, or the value of the product will be returned to him in question. All special orders are non-refundable, according to OGU 34/2014, art 16 letter c.

This warranty does not include damage to the jewelry due to failure to follow instructions for use, accidents, carelessness, negligence, general misuse, or other factors unrelated to defects in material or workmanship. According to OUG 140/ 2021, the buyer cannot ask for the replacement of the jewel due to the stones falling off.

Any repair to the products within the warranty period will be carried out free of charge or will be replaced under the conditions of OG no. 21/1992 revised, if it is confirmed that a defect in material or workmanship was the cause of such damage, rather than improper use of the jewelry by the buyer.

The remedy will be done within 5 – 15 days from the date the deficiency was discovered.

During the warranty period, as well as outside it, we do not assume responsibility for problems that may arise due to mechanical factors, non-compliance with the instructions regarding the use and care of the jewelry, specified in the Instructions for use of the jewelry, nor for the repairs performed in other place than where the product was purchased.

Failure to notify moogustore.ro, by written means, of the deficiencies/lack of conformity of the purchased products within 3 months from the date of their purchase, leads to the loss of the warranty.

The transport costs related to the return during the warranty period of some products in order to remedy some problems that are exclusively due to us, through repair or replacement, will be borne by us.

Information regarding returns for sizing and other adjustments beyond our control:

In the event that, by mistake, you sent us the wrong measurements for the custom-made object and upon receiving the product you find that it does not match the actual measurement (e.g. rings, earrings, etc.) we undertake to bring the respective product to actual size in all cases where this is technically possible.

The costs for size changes and other arrivals that are not due to us, are borne by the customer.

The guarantee, regarding wedding rings and engagement rings, includes a single size adjustment for each wedding ring/ring at no additional cost to the customer.

Also, if after receiving the product you want certain adjustments that are technically possible, we will try to make the necessary changes.

In the above situations, the transport costs related to the return of some products in order to adjust the size and other adjustments for reasons that are not due to us, will be borne by the customer.

PRICE POLICY

Prices do not include delivery costs. The LEI-EURO/GBP exchange rate is calculated at the current rate of the BNR.

The price of Moogu products is not calculated per gram of metal (gold, silver). The weight of the products displayed on the website is indicative, it can undergo changes with a deviation from 0.10 grams to 1.5 grams (especially in the case of wedding rings or special orders).

Moogu Design SRL, legal owner of www.moogustore.com, is registered in the Personal Data Processing Register under number 30880. MOOGUSTORE.com keeps and uses your personal data strictly in order to provide you with our services, to provide you with support regarding your orders, to inform you of changes in our services and any new services that we or our partners offer.

You are not required to provide us with your information, but in order to successfully place an order on www.moogustore.com, additional information about you is required.

Regarding payment security, we use the MOBILPAY platform, known for its security solutions for card payments. This payment is made on a redirected page and provided by MOBIL PAY. Completing your data is secure, so MOOGU DESIGN SRL does not have access to your bank account details.

SECURITY OF PERSONAL DATA

Your personal data will be used by MOOGU DESIGN SRL to confirm orders, inform you by e-mail, post or other means of communication about subsequent actions. Personal data may be transmitted to legal authorities for the purpose of verifying commercial transactions or to other legal authorities to carry out any checks justified by law. Data provided by customers is strictly confidential. MOOGU DESIGN SRL undertakes to its customers not to provide this data to third parties or companies. MOOGU undertakes to respect your rights conferred by Law 677/2001 and to stop processing your personal data if their use is not in accordance with Law no. 677/2001. Bank card data information (card number, expiration date, etc.) will not be transferred or stored on our servers.

We have not and will never sell your data to third parties. We offer services that are based on customer trust, and the safety of personal data is essential in this process.

Our purpose with social media is educational, and the new data protection rules (GDPR) are part of this context. Therefore, we promise you that the safety of your data is a priority for us and that we use this data for the sole purpose of providing you with a personalized experience both on our website and on the online platforms on which we promote our products and services ( Facebook and Google).

Only if you have provided us with your personal data and given your consent will we use it as follows:

Email address: we will use it to send you informational emails about our products and services, but also about the articles and resources that we periodically publish on this site.

Browser/IP/Device Data: We use this data to determine how you use our site, with the aim of making the necessary changes to make it easier for you to find the information you are looking for; also, because we use an e-commerce platform, the IP address can help us in the event of fraud, if the responsible institutions request this data;

We have taken all the technical measures so that you are not obliged to provide us with any data (everything is optional), but it is good to know that without them it is possible that certain parts of the site may not work correctly, we may collaborate, or we may not be able to notify you about our services that you may be interested in.

It is forbidden to reproduce, publish, distribute, display, modify and create works derived from the displayed products, or to exploit in any way, in whole or in part, the content without the prior express written consent of MOOGU DESIGN SRL.

The products are handmade, modeled and sculpted in wax. Because of this, there will be slight differences in texture, shape and patina. Handmade jewelry cannot be identical to the model displayed on the website or in the showroom.
