TERMS & CONDITIONS

1. GENERAL INFORMATION

The site www.moogu.ro / moogustore.com is owned and operated by MOOGU DESIGN SRL, located at Str. Aleea Haiducului nr. 3, bl. A4, sc. 1, ap. 6, Sector 6, Bucharest, Romania, registered with the Trade Register under no. J40/7277/2013, CUI RO31774540.

By accessing the site and placing orders, the user confirms that they are at least 18 years old and fully accepts these Terms and Conditions, including all subsequent changes.

MOOGU DESIGN SRL reserves the right to modify these terms at any time, and the updated version is mandatory for all orders placed after publication.

2. PRODUCTS

All jewelry sold is handmade, using artisanal techniques. Minor differences in shape, texture, finish, patina, or weight compared to presentation images do not constitute defects.

The weight of the products is indicative and may vary between 0.1 g and 1.5 g, especially for wedding rings or custom-made jewelry. The price is not calculated per gram of metal.

Products are sold in their current condition and cannot be considered non-compliant for minor aesthetic reasons.

3. PAYMENT

The customer can choose one of the payment methods:

  • Online payment by card through Shopify Payments or Netopia.

  • Cash on delivery (Romania only)

  • Payment in installments through TBI Bank or PayPro

Payment in installments requires identification documents and proof of a legal source of income. Orders are processed and shipped only after approval confirmation by TBI Bank or PayPro.

No product will be delivered without full payment confirmation or financing approval.

Purchasing gold from the customer

MOOGU DESIGN SRL can purchase gold from the customer, based on a sales contract.

  • The gold brought by the customer will be tested and analyzed for purity and weight before determining the due amount.

  • The price paid to the customer is calculated according to the current gold quotation at the time of the transaction.

  • Payment is made only after confirming the weight and testing the gold, based on a sales contract signed by both parties.

  • MOOGU DESIGN SRL is not responsible for differences in weight or irrelevant purity confirmed by testing.

4. DELIVERY

Transport is carried out by DHL Express courier international and FAN Courier Romania.

  • Romania: 17 – 27 lei, depending on the delivery and payment method. Additional charges for external kilometers apply with the customer's agreement.

  • International: 2 – 7 working days in Europe, up to 18 working days in the rest of the world. Customs duties and other local taxes are the sole responsibility of the customer.

Orders are delivered to the address indicated by the customer. The courier is not responsible for delays or losses caused by incorrect information.

Package tracking is available online, and the customer must pick up the products from the courier's office if they are not found at the address.

5. CUSTOMIZED PRODUCTS AND SPECIAL ORDERS

Products made according to the customer's specifications (wedding rings, engagement rings, customized jewelry) are considered special orders.

  • A minimum advance of 50% must be paid before the production begins.

  • The execution time is a minimum of 14 working days.

  • Special orders cannot be canceled or returned.

  • The advance payment is non-refundable in any case, including for gold exchanges or subsequent modifications of specifications.

Any request for modification after the production has started will be analyzed strictly from a technical point of view and may incur additional costs fully borne by the customer.

6. RETURN AND CANCELLATION

According to OUG 34/2014 regarding consumer rights, products purchased online can be returned within 14 calendar days from the receipt of the order, only in the case of standard products that are in stock and have not been personalized, and only if they are unworn, in the original packaging, with the invoice and authenticity certificates.

Promotional products received as gifts must be returned together with the product.

Return shipping costs are fully borne by the customer. The value of the product will be refunded within a maximum of 3 working days after its receipt and verification. Delivery fees are non-refundable.

Cannot be returned: special orders, customized products, jewelry in specific sizes, pre-orders, wedding rings, engagement rings, gift cards.

7. WARRANTY

Products are covered by a warranty for manufacturing defects and workmanship.

The warranty does not cover damages caused by: normal wear and tear, impacts, improper handling, accidents, or interventions performed in another workshop.

Defect remediation will be done within 5 – 15 working days from the date of detection.

Size adjustments for wedding bands and engagement rings include one free adjustment, if technically possible. Other adjustments are fully borne by the customer.

8. CONFIDENTIALITY

MOOGU DESIGN SRL collects and processes customers' personal data in accordance with national legislation and EU Regulation 2016/679 (GDPR).

  • Collected data may include: first name, last name, address, email, phone number, billing information, and data necessary for processing payments.

  • The purpose of data collection is exclusively: order processing, invoicing, delivery, fraud prevention, communication with the customer.

  • Data may be transmitted exclusively to partners involved in processing orders (courier, payment processor). They are not sold or shared with third parties.

  • Data is retained for the duration necessary for processing the order and in accordance with applicable tax legislation.

  • The customer has the right to request access, rectification, deletion, or restriction of the processing of their data, as well as to object to processing or request portability, via email at contact@moogu.ro.

  • Failure to provide this data completely prevents the placement and processing of orders.

Personal data is used strictly for processing orders, invoicing, delivery, fraud prevention, and communication with the customer. Card data is not stored on the company's servers.

Data will not be sold or distributed to third parties without the express consent of the customer.

9. NEWSLETTER

Subscribing to the newsletter provides a one-time discount code of 10%. The discount does not apply to wedding bands, engagement rings, customized products, or High Jewellery collections.

10. COMPLAINTS

11. COPYRIGHT

All content on the site (images, texts, design, concepts, products) is the property of MOOGU DESIGN SRL and is protected by copyright law. Reproduction or use without written consent is prohibited.
