Moogustore.com (referred to as "moogustore.com" or "we") is owned by MOOGU DESIGN SRL, headquartered at str. Aleea Haiducului nr. 3, bl. A4, sc 1, ap 6, sector 6, Bucharest, registered with the Trade Register under no. J40 / 7277/2013 and unique registration code RO31774540.

Access to and use of this site as well as the products and services available through this site ("the services") are subject to the following terms and conditions ("T & C"). By using the services, you agree to all T & C, as we may update or modify T & C from time to time. You should regularly check this page to be aware of any changes to the Terms and Conditions.
Placing orders on this site means accepting the T&C.

PAYMENT
Payment on www.moogustore.com is your choice.
- You can pay with a card (Visa or Mastercard) through Shopify Payments.
- Cash on delivery of the package
The value of the products and services ordered can be paid to the courier upon delivery to the address specified by you. (*service available only in Romania)
PAY WITH CARD
Together with TBI Pay, we have implemented a financing system directly from the shopping cart of purchases, which allows you to pay in installments, without trips to the bank. You only need to have your ID card at hand and have a source of income registered with ANAF (employee with at least 3 months of seniority, pensioner, or self-employed with at least 12 months of seniority).
Your file will enter analysis, and you will receive confirmation of the approval or denial of the credit via email. Your order will be shipped only after our team receives the confirmation email of the credit approval from TBI.

DELIVERY
The shipping cost varies between 17 LEI and 27 LEI, depending on the payment method, delivery/pickup of the package. Exception: locations without a Fan Courier office - external kilometers will be charged with the customer's agreement.
MOOGU ships orders placed on the online shop with DHL Express to the following countries:

Delivery of orders takes between 2-7 business days for Europe and up to 18 business days for the rest of the countries, depending on the selected delivery address. The order will be delivered to the mentioned address, and only if the courier cannot find you, you will receive a notification in your mailbox. In this case, it is your responsibility to pick up the package from the Local Postal Office you belong to.
For online orders with delivery outside the European Union, extra customs fees may apply, depending on the policies and local taxes of your region.
Most orders are shipped the next business day after the order has been placed. Once the order is confirmed and processed, an automatic email will be sent including the tracking number.

The processing time for online orders paid by card may be extended if the billing address is different from the delivery address. (this additional time is used to ensure the safety and security of the card used by you)
* DELIVERY/CREATION OF WEDDING RINGS - after placing the order on the site, if you wish to order them online, you must specify the sizes you want (in an email sent later on contact@moogu.ro). The making of wedding rings takes a minimum of 14 working days and a 50% deposit is paid before the order begins.
CUSTOMS FEES
International orders outside the EU zone may incur additional local customs fees when they enter the destination country.
RETURN OF PRODUCTS
The return policy for products purchased from the store www.moogustore.com aligns with the provisions of Emergency Ordinance no. 34 / 2014 regarding consumer rights in contracts concluded with professionals, as well as for the modification and completion of certain normative acts and OUG no. 140 / 2021 regarding the sale of products and the guarantees associated with them.
Purchased products can only be returned in their original packaging, without being used, worn, or damaged, or missing elements, accompanied by the original sales document (invoice/receipt) and the authenticity certificates issued by MOOGU, in original. Any promotional product or packaging offered as a gift along with the purchased products must also be returned under the same conditions described above, within 14 calendar days from receipt.
MOOGU will refund the value of the returned goods within a maximum of 3 working days from the date of return of the products, by bank transfer. The direct costs incurred by the return of the goods (transport of goods) will be fully borne by the buyer and the return of the products will be made using the same transport service that was used to ship the products to you. The value of the returned products will be refunded minus the delivery fee.
All special orders are non-refundable, according to OGU 34/2014, art 16 lit.c.
Special orders are products created and requested by the customer according to the customer's specifications, including wedding rings, engagement rings, created in the sizes ordered by the customer, even those that are not engraved.
The right to withdraw from the purchase does not apply to products that have been personalized.
The right to withdraw from the purchase does not apply to products purchased through pre-order.
This category includes but is not limited to: jewelry created in the sizes ordered by the customer, even those that are not engraved, decorations made with a design described and requested by the customer, any other items made to special order, which have or do not have as a starting point (in terms of shape, color, design, dimensions, material, etc.) an item from the store, but for which special adaptations requested by the customer have been made.
In the event that the customer has paid a 50% deposit for a special order (wedding rings, engagement rings, other jewelry) and changes their mind wanting a refund, this is not possible.
In the event that the customer wishes to bring gold as a deposit for special, personalized orders, engagement rings, or wedding bands, it can only be returned under certain conditions.
The right to withdraw from the purchase does not apply to Gift Cards/Vouchers.
However, we assure you that we will do our best to amicably resolve any issues that may arise during the course of our collaboration with you.
INFORMATION REGARDING THE RIGHT OF RETURN
When do you have the right to return an ordered product (withdrawal from the contract)?
If a product ordered by you that does not require execution (is in our stock at the time of ordering) proves to be non-compliant with the specifications presented on the site or in the offer made following a prior dialogue, you may request the return of this product (withdrawal from the distance contract, according to art. 9 para. 1 of OUG no. 34 / 2014) without having to justify this decision, within a maximum of 14 calendar days from the date you take physical possession of the products (the date of receipt of the package, as evidenced by the documents provided by the courier company).
Necessary formalities
To exercise your right of withdrawal, you must inform us of your decision to return the product (withdrawal from the contract) by writing to us at: contact@moogu.ro, in which you express your decision to return the ordered product(s). We will promptly send you a confirmation email acknowledging receipt of your request to return the ordered product(s).
How do you return the product(s)?

Refund of paid amounts:
We will refund all amounts we have received as payment from you within 3 working days from the date of return of the products. The refund of amounts will be made in accordance with the above deadlines, but not earlier than the receipt of the product(s) that were the subject of the sale and, respectively, of the withdrawal (return) request.
Non-refundable costs:
The direct costs incurred by the return of the goods (transport of goods and return money fees) will be fully borne by the buyer.
INFORMATION REGARDING RETURNS FOR WARRANTY
We commit to delivering products that comply with your requirements and with the tax documents issued to you. If after receiving the ordered product(s) you find a non-conformity, as defined in OUG no. 140 / 2021 regarding the sale of products and the associated guarantees, or if you find that the products require size adjustments, you have the option to return the ordered product(s) for remedy.
All products have a warranty, which refers to defects in workmanship or production. In the event that such a defect is found, the product will be repaired or replaced with another one, and if it is out of stock, the buyer has the right either to choose another product in stock or to be refunded the value of the product in question. All special orders are non-refundable, according to OGU 34/2014, art 16 lit.c.
This warranty does not cover damage caused to the jewelry due to non-compliance with the user instructions, accidents, carelessness, negligence, generally improper use, or other factors unrelated to material or workmanship defects. According to OUG 140/2021, the buyer cannot request the replacement of the jewelry due to stone fall.
Any repair to products within the warranty period will be carried out free of charge or will be replaced under the conditions of OG no.21/1992 revised, if it is confirmed that a material or workmanship defect was the cause of such damage, rather than improper use of the jewelry by the buyer.
The remedy will be made within 5 – 15 days from the date of the deficiency detection.
During the warranty period, as well as outside of it, we do not assume responsibility for problems that may arise due to mechanical factors, non-compliance with the instructions regarding the use and care of the jewelry, specified in the Jewelry User Instructions, nor for repairs carried out elsewhere than where the product was purchased.
Failure to notify moogustore.ro, in writing, of the deficiencies/non-conformities of the purchased products within 3 months from the date of purchase will result in the loss of warranty.
The transportation costs related to the return during the warranty period of certain products for the remedy of issues that are exclusively our responsibility, through repair or replacement, will be borne by us.
Information regarding returns for size adjustments and other adjustments for reasons that are not our responsibility:
In the event that, due to an error, you have provided us with incorrect measurements for the custom-made item and upon receiving the product you find that it does not fit the actual measurement (e.g. rings, earrings, etc.), we commit to bringing the respective product to the actual size in all cases where this is technically possible.
The costs for size modifications and other adjustments that are not our responsibility are borne by the customer.
The warranty, regarding wedding rings and engagement rings, includes one size adjustment for each wedding ring/ring at no additional cost to the customer.
Also, if after receiving the product you want certain adjustments that are technically possible, we will try to make the necessary changes.
In the above situations, the transportation costs related to the return of products for size adjustment and other adjustments for reasons not attributable to us will be borne by the customer.
PRICE POLICY
Prices do not include shipping costs. The LEI-EURO/GBP exchange rate is calculated at the current BNR rate.
The price of Moogu products is not calculated per gram of metal (gold, silver). The weight of the products displayed on the site is indicative and may vary by a deviation of 0.10 grams to 1.5 grams (especially in the case of wedding rings or special orders).
PRIVACY POLICY
Moogu Design SRL, the legal owner of www.moogustore.com, is registered in the Register of personal data processing under number 30880. MOOGUSTORE.com keeps and uses your personal data strictly to ensure our services, to provide support regarding your orders, to inform you of changes in our services, and any new services that we or our partners offer.
You are not obliged to provide us with your information, but if you wish to successfully place an order on www.moogustore.com, additional information about you is required.
Regarding payment security, we use the MOBILPAY platform, known for its security solutions for card payments. This payment is made on a redirected and secured page by MOBIL PAY. Completing your data is safe, so MOOGU DESIGN SRL does not have access to your bank account details.
PERSONAL DATA SECURITY
Your personal data will be used by MOOGU DESIGN SRL to confirm orders, inform via email, mail, or other means of communication about subsequent actions. Personal data may be transmitted to authorities for the purpose of verifying commercial transactions or other authorities for conducting any justified checks based on the law. The data provided by customers is strictly confidential. MOOGU DESIGN SRL commits to its customers not to provide this data to third parties or companies. MOOGU undertakes to respect your rights granted by Law 677/2001 and to cease processing your personal data if their use is not in accordance with Law no. 677/2001. Information regarding bank card data (card number, expiration date, etc.) will not be transferred or stored on our servers.
We have not sold and will never sell your data to third parties. We offer services based on customer trust, and the security of personal data is essential in this process.
Our goal regarding social media is educational, and the new personal data protection regulations (GDPR) are part of this context. Therefore, we promise you that the security of your data is a priority for us and that we use this data solely to provide you with a personalized experience both on our website and on the online platforms where we promote our products and services (Facebook and Google).
Only if you have provided us with your personal data and you have given your consent will we use it as follows:
Email address: we will use it to send you informational emails regarding our products and services, as well as the articles and resources we periodically publish on this site.
Name and surname: we use this data to personalize the emails you receive from us. The platform we use for email marketing (Mailchimp) allows us to personalize based on the data provided by subscribers; Also, where applicable, we use this data to conclude the contract that establishes a commercial agreement with Moogu Design Srl or for billing.
Phone number: we use this data to contact you quickly, in order to inform you about last-minute changes.
Company name/billing data: we use this data to conclude the contract that establishes a commercial agreement with MOOGU DESIGN SRL or for billing.
Browser/IP/device data: we use this data to determine how you use our site, with the aim of making the necessary changes so that you can find the information you are looking for more easily; also, because we use an e-commerce platform, the IP address can help us in the event of fraud cases, if the responsible institutions request this data;
We have taken all technical measures so that you are not required to provide us with any data (everything is optional), but it is good to know that without them, certain parts of the site may not function correctly, we may not be able to collaborate, or we may not be able to inform you about our services that you might be interested in.

It is forbidden to reproduce, publish, distribute, display, modify, and create derivative works from the displayed products, or to exploit in any way, in whole or in part, the content without the prior express written consent of MOOGU DESIGN SRL.
The products are handcrafted, molded, and sculpted in wax. For this reason, there will be small differences in texture, shape, and patina. Handcrafted jewelry will not be identical to the model displayed on the site or in the showroom.
